£5,000 Fly-Tipping Fine Marks Toughest UK Waste Crime Crackdown Yet

Illegal waste disposal is about to become far more expensive.

Under new legislation announced by the UK Government, the maximum fixed penalty for fly-tipping will increase from £1,000 to £5,000 – a 400% increase and the highest on-the-spot penalty introduced to date. The maximum fine for littering will also rise by 50%, increasing from £500 to £750.

The new penalties are expected to come into force during summer 2026 as part of the Government’s ongoing campaign against waste crime.

The Biggest Increase Targets Fly-Tipping

Fly-tipping continues to place a significant financial burden on councils while damaging roadsides, industrial estates, rural areas and public spaces.

The new legislation gives local authorities much stronger enforcement powers by raising the maximum Fixed Penalty Notice to £5,000.

Councils will still decide the value of each fine, allowing penalties to reflect the seriousness of the offence. However, the new upper limit sends a clear message that illegal dumping is no longer being treated as a low-level environmental offence.

Littering Penalties Also Rise

People caught dropping litter could also face substantially higher fines.

The maximum Fixed Penalty Notice will increase to £750, giving councils greater flexibility to issue tougher penalties where appropriate.

Rather than applying a single fixed amount, local authorities will continue setting fines within the legal range based on the circumstances of each case.

Higher Fines Are Only Part of the Crackdown

The legislation sits alongside several enforcement measures already introduced under the Government’s Waste Crime Action Plan, including:

  • A national digital waste tracking system to improve waste traceability.
  • Stronger court powers that allow waste carriers involved in fly-tipping to risk losing their licence.
  • Enhanced background checks designed to prevent rogue operators from entering the waste sector.
  • Updated guidance helping councils identify, seize and prosecute vehicles used in illegal waste dumping.

Together, these measures are intended to make waste crime more difficult to carry out and easier to investigate.
